  1. GENERAL

1.1

These general terms and conditions ("Terms") apply when you, as a consumer ("You"), place an order via www.posterton.com, and related pages, ("the Site"). An agreement is made between you and Posterton AB, organization number 559270-9553 ("Posterton"). Detailed contact information and other information about Posterton are provided on the Site. The Terms are only applicable to you as a consumer placing orders via the Site.

1.2

To place an order on the Site, you must be at least 18 years old. Posterton does not accept credit purchases by persons under 18 years of age, in accordance with Swedish law. Posterton reserves the right to, in individual cases, deny or modify your order (for example, if you have provided incorrect personal information and/or have payment defaults).

1.3

Posterton reserves the right for final sale and any image or typographical errors on the Site, such as errors in product descriptions or technical specifications, incorrect prices, and price adjustments (such as changes in prices from suppliers or currency changes) or incorrect information regarding whether a product is in stock. Posterton has the right to correct such errors and change or update the information at any time. If an incorrect price has been stated for a product you have ordered, Posterton will naturally inform you of this and await your approval of the corrected price before continuing with the order. All image information on the Site should be viewed solely as illustrations. Such illustrations cannot guarantee the product's exact appearance. Posterton is not responsible for information on the Site that comes from a third party.

1.4

The Site and all its content are owned by Posterton or its licensors. The information is protected by intellectual property and market laws. This means that trademarks, trade names, product names, images and graphics, design, layout, and information about products, services, and other content may not be copied or used without written permission from Posterton.

  1. AGREEMENT AND ORDER

2.1

To make a purchase on the Site, you must accept the Terms. By accepting the Terms, you agree to comply with the Terms in their entirety and acknowledge that you have read the information about personal data and consent to the use of personal data and cookies according to Posterton's Privacy Policy, see here.

2.2

A purchase agreement is concluded only when Posterton has confirmed your order and you have received an order confirmation from Posterton via email. Posterton encourages you to save this order confirmation for any contacts with Posterton's customer service. You can cancel your order until it has been confirmed by Posterton. If the order is canceled, Posterton will refund any payments you or your payment or credit card company have made for the order.

  1. CUSTOMER INFORMATION

3.1

When you register your user account and/or place an order, you will be asked to provide certain personal information. You confirm that the information you provide is correct and complete and are responsible for any incorrectly filled out information. Information about Posterton's processing of personal data is available in Posterton's Privacy Policy.

3.2

You are responsible for ensuring that no one else can use your login details. You must not disclose your username and password to anyone unauthorized and must ensure that any document with information about your username and password is stored in a way that unauthorized persons cannot access the information. You must immediately notify Posterton if you suspect that an unauthorized person has access to your password. You are responsible for all purchases made with your login details if such notification has not been made.

3.3

If Posterton suspects that you are misusing your user account or login details or otherwise violating the Terms, Posterton has the right to suspend you. Posterton also has the right to assign you new login details.

  1. PRICES, FEES, AND PAYMENT

4.1

When ordering via the Site, the prices stated on the Site apply. Prices are stated in Swedish kronor and include VAT. The prices do not include payment and shipping fees, which are stated separately.

4.2

You can pay in the ways indicated on the Site. Posterton has the right to charge already at the time of the order unless invoice payment or other similar payment methods have been chosen by you and approved by Posterton. For invoice payment or installment payment, Posterton or its partners may carry out a credit check. You will be informed of this in such a case. Posterton reserves the right not to always offer all payment methods, or to change the payment method if the one you have chosen does not work at the time of purchase. Note that any limitations on payment options are stated on the Site.

  1. CAMPAIGNS AND OFFERS

5.1

Posterton may offer promotions on the Site from time to time that may have more favorable terms than those provided in these Terms, for example regarding payment or extended right of withdrawal. These more favorable terms apply as long as the campaign is active and for the specific products stated by Posterton in connection with the campaign. Posterton reserves the right to withdraw such campaigns at any time. Upon conclusion or withdrawal of a campaign, these Terms apply without amendments. Offers on specific products on the Site are valid for a limited time and as long as stock lasts.

  1. GIFT CARDS

6.1

Gift cards sold at Posterton are valid for two (2) years from the date of issue and can be used on Posterton's webshop. Once the validity period has expired, the card cannot be used as a means of payment, reactivated, and the remaining value cannot be refunded. Your gift card is a valuable document that should be stored safely and cannot be exchanged for cash.

  1. DELIVERY AND TRANSPORT

7.1

Products in stock are normally delivered within the number of working days stated on the Site. Unless otherwise agreed (for example, when booking products that are not in stock), delivery is made no later than 30 working days from when Posterton has confirmed the order in writing through the order confirmation.

7.2

The expected delivery time of the product is stated in the order confirmation, at checkout, and/or on the relevant product page on the Site. Unless otherwise agreed, and if a delivery takes more than 30 working days and this is not due to you as a customer, you have the right to cancel the purchase.

7.3

If a package is to be picked up, you should do this within the time stated in the notification. Packages should normally be picked up in person with valid identification and order number. You will always receive a notification showing where and when the package should be picked up. Notification can be made via email, regular mail, and if you have provided a mobile number, also via phone call or SMS. If you do not pick up the package, Posterton has the right to charge you a fee of 199 SEK.

  1. RIGHT OF WITHDRAWAL

8.1

When purchasing goods on the Site, you always have a 30-day right of withdrawal. This means that you have the right to cancel your purchase by notifying Posterton of this within 30 days from the date you or your agent received the ordered product (withdrawal period). The right of withdrawal or exchange does not apply to personalized posters that are customized and printed on order.

8.2

In connection with an order for a product for which the right of withdrawal does not apply, you will receive clear information about this. If a product has been sealed, you must not break the seal if you want to exercise your right of withdrawal. The right of withdrawal ceases when you break the seal.

8.3

If you want to cancel the purchase, you must send a clear and unambiguous message to info@posterton.com before the withdrawal period has expired. You should provide your name, address, and other relevant information, such as order number, invoice number, and the name of the product in the message. If you do not want to use the above option for a message, you can use the standard form for exercising the right of withdrawal developed by the Swedish Consumer Agency (see www.konsumentverket.se).

8.4

When exercising the right of withdrawal, you pay the return shipping and are responsible for the condition of the product after you have received it and during the return shipping. The product should be returned within 30 days from the date the notice of withdrawal was submitted to Posterton. The product should be sent well-packaged, in good condition, and in the original box. Returns should be made to Posterton according to the methods and instructions stated on the Site, which you can find here.

8.5

When you cancel your purchase, Posterton will refund the amount you paid for the product, excluding delivery costs. Posterton has the right to deduct a sum corresponding to the product's decrease in value compared to the product's original value, if and to the extent such decrease in value is due to you having handled the product to a greater extent than necessary to determine its characteristics or function.

8.6

Posterton will refund the amount as soon as possible, but no later than 14 days from the date Posterton received your notice of withdrawal. Posterton may, however, wait with the refund until Posterton has received the product or you have shown that the product has been sent back, e.g., through a delivery receipt. The refund will be made to you via the payment option you chose, provided that nothing else has been agreed or there are obstacles to such a refund.

  1. WARRANTY AND COMPLAINTS

9.1

Some of Posterton's products may be covered by a warranty. Information about any warranty period and specific warranty conditions for each product is available on the Site or in these Terms. The warranty for products only covers original manufacturing defects, and thus not defects that arise during or after a personal modification of the product's function and appearance, such as rebuilding, upgrading, or other configuration of the product. Your order confirmation serves as proof of warranty.

9.2

The right to complain covers products that are defective according to applicable consumer protection legislation. Customers wishing to assert a defect in an ordered product should contact Posterton as soon as possible after the defect is discovered via the contact details provided on the Site. Complaints made within two months of you discovering the defect are always considered to have been submitted in time. You have a 3-year right to complain about products purchased on the Site.

9.3

Posterton covers the return shipping for approved complaints.

9.4

When a complained product has been returned and the complaint approved, Posterton will compensate you in accordance with applicable consumer protection legislation. Posterton strives to do this within 14 days from when Posterton received the complaint, but it may take longer depending on the nature of the product. Posterton reserves the right to deny a complaint if it turns out that the product is not defective according to applicable consumer protection legislation.   1. LINKS

10.1

Posterton may link to other websites that are outside of Posterton's control, and websites outside of Posterton's control may link to the Site. Even if Posterton tries to ensure that Posterton only links to websites that share Posterton's privacy and security regulations according to the Privacy Policy, Posterton is not responsible for the protection or confidentiality of information or personal data that you provide on other websites. You should exercise caution and read the privacy policies of the relevant site.

  1. FORCE MAJEURE

11.1

Posterton is not responsible for delays caused by circumstances that Posterton could not control, such as general labor conflicts, extreme weather conditions, war, fire, lightning strikes, terrorist attacks, changed government regulations, technical problems, faults in electrical/telecommunications/data connections, or other communication and faults or delays in services from subcontractors due to circumstances stated above. These circumstances constitute grounds for exemption which entail exemption from damages and other penalties. If such a situation arises, Posterton will inform you both at the beginning and the end of the period for the current situation. If the circumstance has lasted longer than two months, both you and Posterton have the right to cancel the purchase with immediate effect.

  1. CHANGES TO THE TERMS

12.1

Posterton reserves the right to make changes to these Terms at any time. All changes to these Terms will be published on the Site. Changes apply from the moment you have accepted the Terms (in connection with a new purchase or visit to the Site), or 30 days after Posterton has informed you of the changes. However, Posterton recommends that you stay updated on the Site regularly to be aware of any changes to the Terms.

  1. INVALIDITY

13.1

If a competent court, authority, or arbitration panel finds any provision of these Terms to be invalid or unenforceable, the provision in question and all other provisions will remain valid and enforceable to the extent permitted by applicable law. The provisions that have been declared invalid or that cannot be enforced will be replaced by relevant legal guidance and advice.

  1. APPLICABLE LAW AND DISPUTE

14.1

Disputes shall primarily be resolved in consensus after discussion with Posterton's customer service.

14.2

If a dispute cannot be resolved in consensus with Posterton's customer service, you as a customer can turn to the Swedish National Board for Consumer Disputes (ARN), which you can find more information about at www.arn.se. You can also file a complaint online via the EU Commission's platform for dispute resolution, which you can find via the following link http://ec.europa.eu/consumers/odr. If you file a complaint via this platform, your case will be automatically forwarded to the appropriate national dispute resolution body. This dispute resolution body then contacts us and tries to resolve the dispute without involving a court. In the event of a dispute, Posterton follows decisions from ARN or the corresponding dispute resolution body.

14.3

Disputes concerning the interpretation or application of these Terms shall be interpreted in accordance with Swedish law and decided according to point 14.2 above or ultimately by a general court.
